Who is at fault in a car accident?
In some cases, there is one driver who is clearly at fault. But, in other cases, who is at fault might be a little more unclear. There are some basic rules of fault under Georgia law that can establish who was at fault in a car accident.
- If one driver broke a traffic law, and the other did not, the one who broke the law is probably at fault.

If your injuries require lifelong medical care, such as a full-time caretaker, then Georgia courts will allow compensation for these lifelong costs.
Lost wages from missed work: Often, car accident victims have to stay home from work while recovering from injuries. If you have to stay home from work due to your injuries, then you have a right to compensation for your lost income. Essentially, you have a right to all of the money that you would have been able to make at work had you not been injured in the car accident.
Property damage: Economic damages also includes the damage to your physical property, such as your vehicle. The courts will order compensation to repair or replace your damaged vehicle. The amount of these damages will be determined by repair estimates, quotes, or experts.
Noneconomic damages, or “general damages,” are intended to cover all harms and losses that do not have a specific dollar amount. These damages are considered to be intangible. Whereas a medical bill has a set dollar amount, noneconomic damages do not require proof of a specific amount. Instead, the car accident victim (called a “plaintiff”) must prove the pain and suffering, emotional damages, and mental anguish through testimony of witnesses and medical documentation.
Noneconomic damages include:
- Pain and suffering
- Physical pain
- Post-traumatic stress disorder (PTSD)
- Lost quality of life
- Interference with daily activities
- Mental anguish
- Emotional suffering and distress
- Loss of earning capacity (ability to earn money)
Under Georgia law, there is no limit on the amount of damages a car accident victim can recover. This includes both economic and noneconomic damages. Generally, courts and juries will decide the amount of noneconomic damages (pain and suffering) by hearing witness testimony about how much the victim has gone through.
